Scope of Terms and Conditions
These terms and conditions apply to use of all of the sites and services owned or operated by the Da Vinci Science Center. These terms and conditions do not apply to use of those sites to which the website links.
Use of Materials Posted on Website
The Da Vinci Science Center’s digital assets are protected by copyright and trademark laws, and are the property of the Da Vinci Science Center. Digital assets are defined as content from different media (e.g., photographs, video, text, audio, website pages, etc.) preserved in digital form.
Unless otherwise stated, users may print or download digital assets of the Da Vinci Science Center for informational, educational, and other noncommercial purposes provided that the user includes acknowledgement of “Da Vinci Science Center.”
Users may not reproduce, record, publish, modify, or distribute any digital assets of the Da Vinci Science Center for commercial purposes without prior written consent from the Da Vinci Science Center.
High-resolution versions are available for many of the items included in the Da Vinci Science Center’s digital asset catalog.
Requests for commercial use of digital assets or questions as to whether a specific use is permissible or requires written consent should be sent to ask@davincisciencecenter.org.
News media groups or outlets for use of any image should be sent to news@davincisciencecenter.org.
Conduct
Users shall not post on the Da Vinci Science Center website any content which is libelous, defamatory, obscene, pornographic, abusive, harassing, or threatening, contains viruses or other contaminating or destructive features, violates the rights of others, such as content which infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity, or otherwise violates any applicable law.
You may not post on the Da Vinci Science Center website any links to any external site. The website may not be used by you for any commercial purpose, to distribute any advertising or solicitation of funds or goods and services, or to solicit users to join competitive online services.
Links
The Da Vinci Science Center welcomes links to the website. Permission to create a link to the website is not required. However, the Da Vinci Science Center reserves the right to request removal of a link from any website it believes does not further its mission. Users may not enclose pages from the Da Vinci Science Center website within a frame set of their respective websites.
The Da Vinci Science Center website may provide links and pointers to websites maintained by other individuals, groups, companies, nonprofit organizations, or government entities. The Da Vinci Science Center is not responsible for the availability of any other site to which the website links. The Da Vinci Science Center also does not endorse or take responsibility for the content, advertising, products, or other materials made available through any other site.
Under no circumstances shall the Da Vinci Science Center be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with use of, or reliance on, any content, goods or services available on any other website.
Submissions
The Da Vinci Science Center is not responsible for material appearing on any message board, chat room, or similar interactive service appearing on the website except for material signed by an identified representative of the Da Vinci Science Center.
The Da Vinci Science Center is not responsible for screening material posted by users for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or for any other purpose. The Da Vinci Science Center does, however, retain the right to modify or remove messages or other material that it, in its sole discretion, consider infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable. The Da Vinci Science Center also reserves the right to edit materials for any other reason. Whether or not the Da Vinci Science Center modifies or removes such material, users remain solely responsible for the content of their own messages or postings.
By submitting content to the Da Vinci Science Center website, the user gives (or warrants that the owner of such rights has expressly granted) the Da Vinci Science Center the nonexclusive right to use the user’s questions, comments, and postings, in their original or edited form, in television programs, books, articles, commentaries, or in any other medium now known or later developed. Users are not entitled to any compensation for such use.
Any messages sent to the Da Vinci Science Center will be treated as nonproprietary and non-confidential and will become the property of the Da Vinci Science Center where it may or may not be used for any purpose.
Security
Violations of system or network security are prohibited and may result in criminal and/or civil liability. The Da Vinci Science Center will investigate incidents involving such violations and may involve and cooperate with law enforcement if a criminal violation is suspected. The services and materials of the Da Vinci Science Center website are provided “as is” and without warranties of any kind, either expressed or implied. The Da Vinci Science Center disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Neither the Da Vinci Science Center nor any of its respective licensors, partners, or suppliers warrant that any functions contained in the site will be uninterrupted or error-free, that defects will be corrected, or that the site or the server(s) that makes them available are free of virus or other harmful components.
Neither the Da Vinci Science Center nor any of its respective licensors, partners, or suppliers warrant or make any representations regarding the use or the results of the use of the materials in the site in terms of its correctness, accuracy, reliability, or otherwise. The Da Vinci Science Center controls and operates this site from its offices in the City of Allentown in the Commonwealth of Pennsylvania in the United States of America. The Da Vinci Science Center does not represent that materials on the website are appropriate or available for use in all locations. Persons who choose to access the Da Vinci Science Center website from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Choice of Law
If any disputes arise regarding use of the Da Vinci Science Center website, such disputes shall be resolved according to the laws of the Commonwealth of Pennsylvania, without reference to its choice of law provisions, and the federal or state courts of the City of Allentown, Pennsylvania and the County of Lehigh in Pennsylvania shall have exclusive jurisdiction over all claims. If any of these terms and conditions are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions.

The Da Vinci Science Center respects the privacy of its website visitors and participants, and is committed equally to protecting the privacy and security of the users of the website.

The Da Vinci Science Center will not sell, trade, nor give out e-mail addresses to companies or other organizations. The Da Vinci Science Center will not disclose intentionally any personal identifiable information about an individual user (such as, for example, the user’s full name, street address, telephone number or e-mail address) to any third party without having first received the user’s permission.
The Da Vinci Science Center may request personal identification information from users in connection with their use of, or participation in, contests, sweepstakes, games, surveys, submissions, chat, and bulletin boards. However, the Da Vinci Science Center will collect this personal information only from users if it has been submitted voluntarily.
Any personal information provided to the Da Vinci Science Center may be used in connection with the activities previously referred to above. Should a user send an e-mail message with questions or comments, the Da Vinci Science Center may use the user’s personal information in order to respond to the user’s questions or comments. The Da Vinci Science Center also may keep a user’s comments or questions for future reference.
It is important for users to note that if they give out personal information on the web, through a message board or chat room, for example, that information may be collected and used by third parties. Although the Da Vinci Science Center strives to protect the privacy of its users, the Da Vinci Science Center cannot guarantee the security of information you post in these arenas. Exception
One exception to this policy is that the Da Vinci Science Center will release specific information about a user or a user’s account to comply with any valid legal process such as a search warrant, subpoena, statute, or court order.
Privacy of Minors
Consistent with the Children’s Online Privacy Protection Act of 1998, the Da Vinci Science Center will never knowingly request personally identifiable information from anyone under the age of thirteen (13) without prior verifiable parental consent.
If the Da Vinci Science Center becomes aware that a user is under the age of thirteen (13) and has registered without prior verifiable parental consent, then the Da Vinci Science Center will remove his or her personally identifiable registration information from its files. Users should note that the Da Vinci Science Center may nevertheless maintain a record of that person’s name and address in a “do not register” file to avoid subsequent registration by a child under the age of thirteen (13).
Use of Cookies
A cookie is a small data file stored on the user’s hard drive which may contain information about the user. The Da Vinci Science Center website uses cookies but do not store personally identifiable information in a user’s cookie. Cookies from registered users will allow the Da Vinci Science Center to recognize the user when he or she returns to the website and provide access to the user’s account information. Security of Credit Card Information
The Da Vinci Science Center and its partners use advanced data encryption systems to ensure the security and confidentiality of information exchanged between the user and website-related e-commerce servers. All personal user information (including credit card numbers) will be encrypted and then transmitted from the user’s browser to the Da Vinci Science Center’s e-commerce systems securely. This information can only be unencrypted by the Da Vinci Science Center or its agents. The Da Vinci Science Center can only guarantee secure transactions with orders placed directly from the website using its secure web ordering system. The Da Vinci Science Center cannot guarantee secure transactions for orders sent via e-mail.
